These Terms of Service (hereafter referred to as the “Terms”) shall govern the circumstances by which you (the “User”) may engage the CoolCash mobile application (the “App”) and the CoolCash website (the “Website”), licensed to Cool Loans Limited (hereafter referred to as “CoolCash”) by Caribbean Property Managers Ltd, and the products and services offered by CoolCash through the App and Website, collectively referred to as the “Services”. Accessing the Services, inclusive of but not limited to; the download of the App, registration as a user of the App, submission of material or information through the App or otherwise, whether or not for the purpose of acquiring a loan signifies full and complete acknowledgement and acceptance by the User of the provisions put forth in these Terms. If you do not agree to these Terms, you may not access or use the Services.
DISCLAIMER
You agree to engage the Services at your own risk. CoolCash may not be held liable for any losses or damages that may occur as a result of you engaging our Services such as system failure, non-delivery of data, computer viruses, or security breaches. We cannot guarantee that the Services will not have delays, uninterrupted access, errors, or loss of transmitted data. The information contained within the Websites or App can be changed at any time without prior notice. Changes to our Terms take effect once the adjustments are made. Users who have active CoolCash Loans will be subject to the Terms in their exact form as at the date the User’s application was submitted.
We do not endorse nor do we accept liability for the content of other websites linked to through the Websites or App. Users should read the terms and conditions of third-party websites before using them. You may not link to the Websites from your own website without our consent, which we may grant or deny. There is no guarantee that any message you send to us will be completely secure and could be intercepted or lost. We are not liable for any lost or intercepted message or for any damages that result from that message.
The Websites uses cookies, which will record the pages you visit within our website and the time you spent on the website. You can disable cookies using your web browser’s settings, but it may affect some of our Website’s functionality.
If you, the User, are dissatisfied with any part of the Terms or Services, your sole and exclusive remedy is to discontinue engagement with the Services.
USE OF THE SERVICES
You may only access the Services once the following requirements are met: (i) you are of 18 years of age or older; (ii) you are a resident of a territory in which CoolCash officially operates; (iii) you are employed in or otherwise operate in official commercial capacity in a territory in which CoolCash officially operates.
Access to the App and all of the Services that are offered in and through the App must be sought only through the use of one’s solely and explicitly owned mobile phone. By accessing the App and such Services you, the User, agree that the mobile device from which you access the Services is solely and explicitly your property and hereby assume responsibility for the engagement of the Services from said mobile device. You are responsible for maintaining the security and secrecy of your username and password and may only possess one account at any given time, unless otherwise authorized by CoolCash. The registration and application processes require submission of personal information such as name, address and bank account details. You agree to submit and maintain accurate, complete and current information when engaging the Services. You agree not to undertake any action to interrupt or disrupt the services or otherwise jeopardize the property of CoolCash. CoolCash reserves the right to deny any and every aspect of the Services to any user for any reason at its sole discretion.
By submitting a loan application through the App you express your willingness to be bound by the contractual terms of the loan agreement put forth, as well as your acceptance of the disbursal and recovery methods and protocols set forth. These Terms will apply to the Fixed-Sum Loan Agreement, with the inclusion of interest rates and fees, which will be entered into by you, the User, with CoolCash.
From time to time, we may introduce special offers or promotions, which you will be notified of via emails, and social media or other forms. Such special offers or promotions are only valid for the specified period or until such a time as CoolCash deems them invalid.
You agree that any notices given to you in relation to any Agreement can be delivered to the email address supplied by you during your application. Any notices may also be communicated to you via your CoolCash account. In such cases, you will also receive by email a prompt to refer to your account. At our discretion, we may also serve any notice or demand to you personally, or leave it or send it to you at your last known address.
Any agreement made with CoolCash is governed by the jurisdiction of the territory in which the agreement is established. Furthermore, all communications made with Users will be made in English, or where relevant the language CoolCash deems appropriate for the territory in which CoolCash is operating.
TRADEMARKS AND COPYRIGHT
All trademarks, copyright, content, software, and source codes contained in the Websites and App as well as our logos, brands, and products within the website are licensed to CoolCash. You may copy, download, or temporarily store information from our website when you use our products and services. You may not republish or redistribute Website or App information to other parties, websites, or in hard copy form without our prior consent.
